Withdrawal Rules

Please note that this is a translation of the Finnish language version of the Withdrawal Rules. In case of any discrepancies between the Finnish version and this English version, the Finnish version shall prevail.

From January 24, 2021, Huutokaupat.com is implementing an auction model where consumers are offered the right to withdraw from a contract of sale under the Consumer Protection Act. Due to the implementation of the new model, the following rules shall apply to Huutokaupat.com Transactions (where Huutokaupat.com acts as the seller) from January 24, 2021:

1.      Huutokaupat.com shall be responsible for the reselling of the item and the withdrawal procedure if the item has been delivered before a withdrawal notice was received

a)      The handling of returned items may however require seller contributions, see paragraph 3 below;

b)      The item shall be considered as delivered once it has been handed over to a consumer (pickups) or surrendered for delivery by post or freight operator (shipments);

c)      The seller must label the item as delivered in the Huutokaupat.com system, and, where necessary, provide proof of the time of actual delivery of the item (such as a tracking code that indicates the time of delivery or the reception acknowledgement of the consumer);

d)      Huutokaupat.com shall notify the seller of a withdrawal by a consumer immediately after receiving notice of the matter.

2.      Huutokaupat.com reserves the right to cancel a contract of sale it has concluded with a seller due to a withdrawal until the item has been delivered to the consumer

a)      Huutokaupat.com shall give notice of the cancellation by email and recover the possible purchase price already paid to the seller with a payment term of seven (7) days;

b)      Huutokaupat.com shall not charge any fees from the seller for a cancelled contract of sale, or refunds any fees already charged;

3.      In the case of a withdrawal concerning an item that has already been delivered, the return procedure depends on the original method of delivery

a)      Where possible, Huutokaupat.com aims to direct any returned postal packages directly to Huutokaupat.com;

b)      If the item was collected, Huutokaupat.com shall primarily aim to provide alternative return arrangements for the item (transaction at the buyer’s location, delivery to a collection point), but the seller shall be obligated at the request of Huutokaupat.com to accept the delivery of a returned item and to ensure its delivery to a new buyer at their expense;

c)      If an item sent by the seller is returned (for any reason, such as the seller's postal agreement or a mistake by the consumer), the seller is obligated to handle any measures pertaining to the return of said items (such as reception and entries made into the Huutokaupat.com system) at their expense and to deliver the item to the location specified by the customer service of Huutokaupat.com at their expense.

In Transactions Between Users (where Huutokaupat.com is not a party to the transaction), the seller is responsible for offering the right of withdrawal if: i) the seller is a trader; and ii) the buyer is a consumer. In this case, the seller is also obligated to ensure that provides the consumer all information pertaining to the right of withdrawal as required under law and official rules.

Each listing is subject to the version of the rules that was available on the Huutokaupat.com website as the listing was submitted.
